Quebec judgment goes in favor of pending 18,000 skilled worker program applications
Quebec judge orders province to continue processing Skilled Worker Program applications
In the latest judgment on the backlog of 18,000 pending applications, Quebec superior court judge has ordered the provincial government of Quebec to continue the processing of pending applications and granted a 10-day temporary injunction in response to arguments by an immigration lawyers’ group.
The Coalition Avenir Quebec government proposed the resistance of processing of previous skilled worker program applications, came before August 2, 2018.
With the introduction of proposed legislation or Bill 9, Quebec immigration minister said, “The Expression of Interest system is a better fit for the CAQ government’s efforts to tailor the selection of skilled workers to labor shortages in regions around the province”. And, “dismissing the application backlog was necessary so the government could focus on selecting candidates in the Expression of Interest pool and reduce processing times from 36 months to six months”.
On this, has made the injunction request to the court in the name of Seeun Park, a South Korean nurse. She has applied to Quebec Skilled Worker Program for a Quebec Selection Certificate (CSQ); however, due to government’s move, she has to create a new profile using the province’s online expression of interest system.
The association argued against the injustice of government as tens of thousands of individuals are waiting for the response on their files including minors and spouses. Moreover, many of them are already working or studying there on a temporary basis.
Guillaume Cliche-Rivard, president of AQAADI was happy with the decision of the court and said, “This is great news and great news for Quebec society”.
